Sexual Assault

Texas law defines sexual assault as any non-consensual sexual contact which involves penetration or contact with the victim’s sexual organs, anus, or their mouth.

Another element of the offense involves force, threats of force, coercion or the manipulation of the victim. If a person has sex with a mentally disabled person, a person who is unconscious, or a person is incapable of understanding the situation or resisting the assault, the sexual assault standard as defined by Texas law applies.

Aggravated Sexual Assault

If the sexual assault involved the use of a deadly weapon, resulted in an injury, violence or the threat of such, the offense is classified as an aggravated sexual assault.

Although both offenses are similar, aggravating factors also include sexual assaults of children on the age of 14, sex with people who aren’t able to resist, and sexual assaults on the elderly.

In general, the Harris County District Attorney’s office will usually pursue aggravated assault charges if weapon or violence was used to compel the victim into the compliance or if the victim was a child, elderly, or disabled person.

Criminal Penalties

Sexual assault is classified as a 2nd Degree Felony in the state of Texas. If convicted, sentencing guidelines include a prison sentence that ranges from 2-to-20 years, a fine of up to $10,000.00, and a lifetime sex offender registration requirement.

Aggravated Sexual Assault cases are classified as 1st Degree Felony offenses in the state of Texas. Convictions carry a potential for a 99-year prison sentence, a fine of up to $10,000.00, and, if ever paroled, a lifetime sex offender registration requirement.

If the defendant is proven to have sexually assaulted a child under the age of 6 or used violence to rape a child under the age of 14, a 25-year mandatory minimum prison sentence will apply.
