Criminal Law Overview

Contrary to what the misleading billboards say, “DRINK, DRIVE. GO TO JAIL,” you can drink then legally drive if you have not lost “the normal use of your mental or physical faculties.” With over twenty years of criminal defense, I’ve represented dozens of people that really did have “just a couple” then commit a minor traffic offense.

If they have a mild odor of an alcoholic beverage on their breath, the offense reports always say, “Strong Odor of an Alcoholic Beverage,” and they are then asked to perform Field Sobriety Tests (that are designed for failure) and may do poorly.

Drink Drive go to Jail

THIS IS NOT THE LAW

Often the person becomes nervous, is probably tired, has eye fatigue, (a strong contributing factor to the failure of the Horizontal Gaze Nystagmus Test).

The suspect may also be non-athletic or not coordinated, thus performing poorly on the field sobriety test and are then arrested.

I’ve found that it is a lot harder to prosecute a person who did not submit to any testing involving a blood or alcohol analysis.

But even if you feel you performed poorly on any test, the police officer may not have followed proper procedure. An example of which is having no reasonable suspicion/probable cause to pull you over and then arrest you, or the officer gave improper instructions during the instruction phase of the field sobriety test.

If this is the case, all the evidence against you might be thrown out.

I have an excellent working knowledge of both the specialized areas of DWI & DUI law and the numerous methods employed by law enforcement in field sobriety testing, probably more so than the arresting officers themselves.

I’ve received dismissals and not guilty verdicts in every kind of intoxication case including Public intoxication, 1st and 2nd DWI, Felony DWI, Intoxicated assault, and Intoxicated Manslaughter.
