Felony DWI Vs. Misdemeanor DWI

The penalties for a felony DWI conviction are substantially more significant than a Class B or Class A misdemeanor DWI. Felony DWI charges usually apply to individuals with multiple previous drunk driving convictions but are always applied to individuals charged with intoxication manslaughter, intoxication assault, and DWI with Child Passenger offenses.

What Makes Your DWI Charge A Felony DWI in Texas?

If you or a loved one were charged with DWI, and have two or more Driving While Intoxicated convictions on your record, the courts will assume that you have a serious problem with alcohol and are a danger to other drivers on the road. Thus, instant Texas Driver License suspension.

Penalties for individuals convicted of a third-degree felony DWI may include a $10,000 fine, up to ten years in prison, and a suspended Texas Driver License for a significant length of time.

The administrative penalty also includes a substantial surcharge fee for multiple years. The convicted party may also be required to have an ignition interlock device (deep lung device) or inhaler installed in their vehicle, which will not allow the engine to start without a breath test or if it detects high BAC reading.
