Texas Law & Sexual Assault of a Child
Sexual Assault of a Child, often referred to as Statutory Rape or Child Molestation, is charged when the perpetrator does any of the following:
- Penetrates the victim’s organ or anus with any object;
- Penetrates the victim’s mouth with their sexual organ;
- There is contact between the victim’s mouth and any other sexual organ or anus; or
- There is contact between the victim’s sexual organ or anus and any other sexual organ, anus or mouth
Sexual Assault of a Child is charged as a Second-Degree Felony. Punishment is two to 20 years in state prison and/or a fine of up to $10,000. But there are variations of this crime that can come with more serious charges and even worse penalties.
- Aggravated Sexual Assault of a Child (or Minor, also called Child Molestation), occurs when the suspect allegedly commits this crime against a child between the ages of 14 and 17: and uses threats, force, weapons or drugs during the commission of the crime. The perpetrator is charged with this crime if any of the following acts were performed:
- Penetrating the victim’s mouth with their sexual organ;
- Contact between the victim’s mouth and any other sexual organ or anus; OR
- Contact between the victim’s sexual organ or anus and any other sexual organ, anus or mouth.
- Continuous Sex Abuse of a Child (under 14), is charged when the suspect is alleged to have sexually assaulted a child (or children) at least twice, at least 30 days apart, in the same manner as described in the two criminal sexual complaints.
Aggravated Sexual Assault is a First Degree Felony, carrying a range of punishment of 5-99 years in prison and up to a $10,000 fine. If the victim was under the age of 6, or if violence was initiated to compel a child under the age of 14 to submit to any sexual act, a 25-year mandatory minimum prison sentence must be served before parole is even considered.
Continuous Sex Abuse of a Child are is also a First-degree Felony, but the minimum punishment is 25-years in prison sentence without the possibility of parole.
