A person commits this act if they knowingly:

  1. Engage in an act using their genitals and an animals mouth or genitals;
  2. Fondles or touches the genitals of an animal;
  3. Causes an animal to contact the sexual fluid of a person;
  4. Inserts a part of their body or any object into the genitals of an animal;
  5. Possesses, Transfers, or Sells an animal for a sexual purpose;
  6. Permits, Causes, or Aids another person in sexual conduct with an animal;

Potential Defenses to Bestiality Charges

It is a Defense to Prosecution under the Texas Penal Code if the act was committed in regular practice of animal husbandry or veterinary medicine.

Punishment

The offense of Bestiality is a State Jail Felony, with punishment in the Texas Department of Corrections for a minimum of 6 months but not more than 2 years. It also carries a fine up to $10,000.

If however the offense resulted in the death of the animal or was conducted in the presence of a child, it is enhanced to a second-degree felony carrying a range of punishment of 2-20 years in the Texas Department of Corrections and up to a $10,000 fine.
