The Most Common Sex Crimes Charged in Texas

POSSESSION OF CHILD PORNOGRAPHY
Under the Texas Penal Code, the crime of possessing child pornography is classified as a third degree felony criminal offense. The offense is a second degree felony if the individual charged is found to be a producer, promoter, or distributor of images depicting children in a sexual nature or engaged in a sexual activity. The maximum sentence for a person convicted of a second degree felony is 20 years.
SEXUAL ASSAULT OF A CHILD (CHILD MOLESTATION)
The Texas Penal Code defines Child Molestation as any number of sexual crimes, including sexual assault of a child, continuous sexual assault of a child, indecency with a child by contact or exposure, and sexual assault of a child under six years of age.
The crime of sexual abuse of a child can be classified as either a first, second, or third degree felony, contingent on the circumstances. If the accused party receives a guilty verdict on their criminal case, the prison sentence and jail time could range from 2 years to life in prison.
SEXUAL ASSAULT
A “sexual assault” charge is based primarily on non-consensual sexual intercourse, which is commonly referred to as “rape.” The offense is a second degree felony under Texas Law which could mean a prison sentence of 2 to 20 years for persons convicted of the crime.
Aggravated sexual assault is a violent offense and one of the most serious sex crimes charges, with severe penalties starting at a minimum of 25 to life. This crime is a first degree felony. INDECENT EXPOSURE
Indecent exposure is a Class B Misdemeanor criminal offense under Texas Law. The crime is defined as recklessly exposing any area of the genital region for sexual arousal. Although a Class B Misdemeanor isn’t a life-threatening criminal classification, indecent exposure is a horrible offense to have on your criminal record. A conviction could mean up to 180 days county jail time.
PUBLIC LEWDNESS
Public lewdness is almost like Indecent Exposure, but involves direct intent as opposed to reckless behavior. This crime is charged as a Class A Misdemeanor. A conviction could mean up to one year of county jail time. Although this crime isn’t like the serious felonies described above, no one needs a record of a conviction for this crime following them for their entire life. A conviction for this offense could result a county jail sentence of up to one year.
