Penalties for 1st DWI Convictions
If a person is convicted of DWI in a court of law, and it’s their first conviction for Driving While Intoxicated, they’ll face punishment under Class B Misdemeanor guidelines which we’ve outlined below.
- Fine: up to 2,000.
- County Jail Time: 3 Days to 6 Months
- Texas Drivers License Suspension: 90 days to 1 year
Even though the penalties following first-time DWI convictions can seem unforgiving, there’s more. One should keep in mind that first-time DWI offenders are now required to have Drunk Driving-Prevention devices installed on their vehicles, at their own expense.
Can I Avoid Jail for DWI in Houston?
People charged with DWI can often avoid county jail time in exchange for agreeing to some form of the probationary term. In fact, 1st DWI offense in texas automatically qualifies for probation rather than jail time, but the stakes are higher if the defendant re-offends by committing DWI a second time.
Although the court has taken a position of automatically offering probation rather than a jail sentence for 1st time DWI offenders, any violation of the community supervision terms can result in the defendant’s relegation to a county jail cell.

Our main objective is to find the best possible outcome for your situation and protect your Constitutional Rights.
