Although most arrests stemming from incidents in which a person was accused of Driving While Intoxicated (DWI) and Driving Under the Influence (DUI) are classified as misdemeanor offenses, certain conditions may compel the District Attorney’s Office to pursue felony DWI charges.
These conditions may include a record of habitual DWI & DUI offenses on the part of the offender, the allegedly intoxicated motorist posed a serious threat to themselves or others, or an accident resulting in death, injury, significant property damage. A combination of said factors can also result in felony DWI charges in Houston.
If an individual is convicted of felony DWI in Texas, depending on the circumstances of the case, the consequences could range from a few thousand dollars in fines and a short state jail stint to life in prison for the most serious offenses some of which may include intoxication manslaughter. If you’re seeking legal representation for yourself or a loved one that may be in such a predicament, call Jack B. Carroll & Associates for help today at 713-228-4607.

When are DWI Offenses Classified as Felonies in Texas?
DWI offenses are classified as felony crimes in Texas when any of the following is true;
- The defendant is charged with DWI a third time,
- The defendant injures someone as a result of intoxicated driving,
- a person is killed as a result of drunk driving,
- or if the motorist is drunk or impaired with a child is present in the vehicle.
Depending on the circumstances of the case and any aggravating factors, a felony DWI may be classified as either a State Jail Felony or a 2nd Degree Felony. Although State Jail & 2nd Degree Felony convictions could mean a few short years in prison, we’ve seen Texas DWI cases in the news featuring defendants sentenced to life. Most of them had a long history of DWI convictions and were sentenced to life imprisonment for driving drunk absent any element of injury or accident. Usually, such a fate is a result of the court finding the defendant to be a habitual offender and a threat to public safety. Below, we’ve linked to a story by the Houston Chronicle which features examples of this reality.
