Indecency with a Child offenses are divided into two specific criminal charges;
- Indecency with a child by contact and
- Indecency with a child by exposure.
Indecency with a Child by Contact
Indecency with a child by contact is a felony offense which can be charged if it’s alleged that sexual contact occurred between an adult and a minor.
Sexual contact is defined by touching, touching through clothing, contact with breasts, anus, or any part of the genital area of the child or causing the child to make the same type of physical contact with the adult.
Indecency with a Child By Exposure
An individual can be charged with indecency with a child by exposure if they cause a minor to expose any part of their genitals or expose their own sexual organs knowing that a child is present.
The prosecution must prove that the defendant intended for the incident to arouse them sexually or to fulfill a sexual desire.
- Indecency with a child by exposure is a 3rd Degree Felony offense in Texas which carries a prison sentence of 2 to 10 years in a TDCJ operated prison facility and a fine of up to $10,000.00.
- Indecency with a child by contact is a 2nd Degree Felony offense which carries sentencing guidelines to the tune of 2-to-20 year prison sentencing with a fine of up to $10,000.00.
Both offenses will require the defendant to register as a sex offender. The length of registration time is contingent on the elements of the crime and primarily the length of the defendant’s prison sentence.
