My client was arrested by a Precinct 4 Harris County Deputy Constable for Driving While Intoxicated (DWI).
The video from the police station of my client was poor quality. He had an accident at a busy intersection, but I noticed several discrepancies in the offense report. I set it for a suppression hearing and made it dispositive (plead guilty if the suppression motion is overruled).

The defense attorney will present his (or her) case first at a suppression hearing because the defendant initially has the burden of proof. I subpoenaed the Harris County Deputy Constable and he ignored the subpoena.
The prosecutor called the constable and he finally made into court.
On cross-examination he said he hadn’t received the subpoena, the prosecutor approached me and said she didn’t believe him.
CASE RESULT: Dismissed
